ABSTRACT
With technological progress, digital therapeutics are gaining importance as an innovative and effective form of treatment, offering new opportunities for the healthcare system in Poland. The aim of this article is to analyze and evaluate the current legal frameworks governing the use of digital therapeutics as a subsidiary form of treatment, with particular emphasis on the challenges faced by the Polish legal system in integrating new health technologies with traditional models of care.
The article introduces the definition and scope of digital therapeutics and their potential applications, followed by a discussion of Polish legal regulations, issues of personal data protection and patient privacy, as well as the related ethical dilemmas. Particular attention is devoted to identifying legal gaps and the need to adapt existing provisions.
The study also compares the regulatory approaches of selected European Union member states, highlighting best practices that may serve as a model for Poland. Based on domestic examples, it presents practical aspects of implementing digital therapeutics.
Finally, the article puts forward de lege ferenda proposals aimed at creating a more flexible and innovation-friendly legal environment, while ensuring a high level of patient and data protection.
