The adoption of the new Code of Medical Ethics was justified by the need to adjust the principles of medical ethics to the contemporary environment for the medical profession's practice. The substantial change concerns Article 9 and the application of teleconsultation in the provision of health services. The abovementioned aspect has essential practical application.
The article aims to interpret Article 9 of the new Code of Medical Ethics, which was obtained on 1 January 2025, and then to attempt to assess the legitimacy of the introduced changes and their impact on the medical profession. The cognitive value of the considerations is manifested in the presentation of the author’s comments on the explanation of Article 9. Moreover, the comprehensive analysis considers the commentary prepared by the Medical Ethics Committee of the Supreme Medical Council. First of all, the previous proposals for the wording of Article 9 have also been discussed to indicate the direction of the evolution of the work of the medical self-government on this provision and point out the main assumptions underlying it.
The perceived need for changes to Article 9 should be assessed positively. The new wording of this provision expresses a more flexible approach to the doctor-patient relationship. However, the way in which Article 9 is interpreted in proceedings concerning a doctor's professional liability will be of key importance.
