ABSTRACT
This article explores the legal implications of parental consent on behalf of a minor under the age of 16. Parental consent does not qualify as a legal act (act in law, declaration of intent), but it exhibits certain features similar to such a statement. Parental consent (in matters related to protection of mental health) may be given unilaterally by one parent. Such an act shall not be qualified as a legal representation of the minor. The foregoing findings entail multiple legal implications, such as those concerning the consequences of non-compliance with the required form of consent, a parent’s silence, or the resolution of disputes between parents.
