This paper focuses on selected Issues of the criminal liability for the participation in the abortion on the basis of provisions being in force. Analysis concerns the possibility of punishing for the incitement and the assistance to terminate pregnancy. The following paper examines the criteria of the act prohibited under Article 152 of the Polish Criminal Code with the blanket clause referring to the Act on Family Planning after the Constitutional Tribunal’s Judgment of 22 October 2020, K 1/20 which judgment eliminated the embryopathological grounds for termination of pregnancy.
