ABSTRACT
The study presents the impact that the development of modern technologies has on the development of mental disorders related to the issue of sanity of the perpetrator of a prohibited act. It discusses both new technologically induced mental disorders described in the literature, although not yet classified, as well as those already included in the current health classifications. Based on the presented criminal cases in which so-called cyber disorders were a significant circumstance considered by the courts in the context of insanity or significantly diminished capacity, conclusions were drawn regarding the possibility of including such disorders de lege lata as the causes of these states. An attempt was also made to analyze the issue of the perpetrator's addiction to modern technologies, treating it as a complementary issue from the perspective of criminal law in relation to the issue of sanity. In conclusion, based on the analysis conducted using the formal-dogmatic method, a perspective approach was also presented, showing selected cyber disorders as a potential genesis of insanity or diminished capacity. The aim of the study is to show the real threats that the development of modern technologies poses to mental health and the problems that arise in the context of criminal liability . In addition, the need for an ongoing, interdisciplinary scientific debate was signaled, justified both by the dynamic development of technology and the growing number of cases indicating its impact on the mental state of an individual, also in the context of criminal law.
