ABSTRACT
This article refers to the key subject connected with criminal liability such as insanity and severely limited insanity. A group of conditions which may have impact on the sanity of a perpetrator of a forbidden act includes “other mental distress” and premenstrual dysphoric disorder may belong to this group. This disorder affects women only and is characterized by the occurrence of both somatic and psychiatrist nature. The objective of this analysis is first and foremost the discussion of a subject of premenstrual dysphoric disorder from a point of view of recognizing this nosological unit as one of the sources of criminal insanity and significantly limited sanity. Whereas, from the analysis of this issue one can conclude that the premenstrual dysphoric disorder may lead to the significant limitation of sanity, however in some cases one should not rule out even the complete preclusion of sanity, however in some cases one cannot rule out even a complete preclusion of sanity of a female perpetrator during the committing by them of a forbidden act.
