ABSTRACT
The patient's right to pastoral care, which is a manifestation of the constitutional right to benefit from religious services, was expressly granted in Articles 36-38 of the Act on Patients' Rights and the Patients' Ombudsman. However, the wording of these provisions is not comprehensive, which makes their interpretation difficult. This article reconstructs the patient's right to pastoral care within the entire legal system. Particular focus is placed on regulations expressing the obligations of healthcare facilities in ensuring the patient’s right to pastoral care, as derived from various regulations. The aim of this publication is to formulate a proposition for the systemic interpretation of Articles 36-38 of the Act on Patients' Rights and the Patients' Ombudsman, and to formulate de lege ferenda postulates regarding them. This should lead to better awareness among patients about their rights and the responsibilities of a medical institution director.
